La présente Politique de confidentialité décrit comment KoulChi collecte et traite vos données personnelles dans le cadre des applications KoulChi et KoulChi Pro. Elle s'inscrit dans le respect de la loi algérienne n° 18-07 relative à la protection des personnes physiques dans le traitement des données à caractère personnel et, l'hébergement étant initialement situé dans l'Union européenne, du Règlement général sur la protection des données (RGPD).

1. Responsable du traitement

Le responsable du traitement est « Koulchi » (entreprise en cours d'immatriculation), Paris (France) et Oran (Algérie). Contact : cherif.bellahouel@hotmail.com.

2. Données que nous collectons

• Données de compte : nom, adresse e-mail, numéro de téléphone (non vérifié), mot de passe (conservé uniquement sous forme hachée).
• Données de commande : articles commandés, montants (en DA), type (sur place / à emporter), créneau et code de retrait, nom et téléphone renseignés pour la commande, demandes spéciales.
• Données de paiement : mode de paiement (espèces au retrait ; paiement en ligne « à venir »). Nous ne stockons aucune coordonnée bancaire.
• Localisation approximative : si vous l'autorisez, afin d'afficher les restaurants à proximité.
• Données d'appareil et notifications : jeton de notification push et plateforme (iOS/Android), pour vous informer du statut de vos commandes.
• Préférences : préférences de notification, favoris, panier.
• Avis et notes que vous publiez.
• Programme de fidélité : points et historique associés, le cas échéant.
• Données des restaurateurs (KoulChi Pro) : informations de l'établissement (nom, téléphone, adresse, position, horaires) et photos des plats.
• Preuve de consentement : type, version et langue des documents acceptés, date et heure, adresse IP sous forme hachée et identifiant technique du terminal (user-agent).
• Données techniques : journaux et rapports d'erreurs nécessaires au bon fonctionnement et à la sécurité.

3. Finalités et bases légales

• Fournir le Service (création de compte, commandes, code de retrait, notifications de statut) : exécution du contrat.
• Géolocalisation des restaurants à proximité et notifications push : votre consentement (révocable à tout moment).
• Sécurité, prévention de la fraude, limitation des abus et amélioration du Service : intérêt légitime.
• Conservation des commandes/paiements et de la preuve de consentement : obligation légale et intérêt légitime.

4. Destinataires et sous-traitants

Vos données sont accessibles au personnel habilité de KoulChi et à des prestataires techniques agissant pour notre compte :

• AWS (Amazon Web Services) : hébergement de l'application et stockage des images (AWS Lightsail et Lightsail Object Storage), région Union européenne — Espagne (Aragon).
• OpenStreetMap / Nominatim : géocodage d'adresses.
• Google (Places) : autocomplétion d'adresse côté restaurateur ; l'affichage des cartes utilise le service de cartographie de la plateforme (Apple/Google).
• Sentry : supervision des erreurs techniques.
• Expo, Apple (APNs) et Google (FCM) : acheminement des notifications push.

Aucun SMS n'est envoyé à ce jour ; un prestataire d'envoi situé en Algérie pourra être utilisé ultérieurement. Vos données ne sont pas vendues à des tiers.

5. Hébergement et transferts internationaux

Les données sont actuellement hébergées dans l'Union européenne (Espagne, région d'Aragon). Un transfert de données en dehors de l'Algérie peut donc avoir lieu, encadré par les garanties applicables. Nous prévoyons de relocaliser à terme l'hébergement et le stockage vers une infrastructure située en Algérie.

6. Durées de conservation

Les données de compte sont conservées tant que le compte existe. Lorsque vous supprimez votre compte, vos données personnelles sont anonymisées. Les commandes, paiements et pièces nécessaires aux obligations comptables, fiscales et légales sont conservés, sous forme anonymisée, pendant la durée légale applicable. La preuve de consentement est conservée le temps nécessaire à la démonstration de la conformité.

7. Sécurité des données

Nous mettons en œuvre des mesures techniques et organisationnelles appropriées : chiffrement des communications (HTTPS/TLS), mots de passe stockés de manière hachée (bcrypt), jetons d'authentification (JWT) avec mécanisme d'invalidation, hachage des adresses IP, contrôle des accès et journalisation limitée.

8. Vos droits

Conformément à la loi algérienne 18-07 et au RGPD, vous disposez des droits d'accès, de rectification, d'effacement (suppression du compte), d'opposition, de limitation, de portabilité, ainsi que du droit de retirer votre consentement à tout moment. Vous pouvez supprimer votre compte et vos données personnelles à tout moment, directement depuis l'Application (Profil → Supprimer mon compte).

9. Comment exercer vos droits

Vous pouvez exercer vos droits depuis l'écran « Confidentialité » de l'Application (« Exercer mes droits ») ou en nous écrivant à cherif.bellahouel@hotmail.com. Vous avez le droit d'introduire une réclamation auprès de l'autorité de contrôle compétente (en Algérie, l'Autorité nationale de protection des données à caractère personnel ; dans l'Union européenne, l'autorité de protection des données du pays concerné).

10. Notifications push

Les notifications push (statut des commandes, informations utiles) nécessitent votre autorisation et peuvent être désactivées à tout moment dans les réglages de votre appareil et/ou dans l'Application.

11. Cookies et traceurs

L'application mobile n'utilise pas de cookies publicitaires ni de traceurs à des fins de profilage marketing. Seuls des outils techniques (supervision des erreurs, mesure du bon fonctionnement) sont utilisés.

12. Mineurs

Le Service n'est pas destiné aux personnes de moins de 16 ans. Si vous pensez qu'un mineur nous a communiqué des données sans autorisation, contactez-nous afin que nous procédions à leur suppression.

13. Modifications de la politique

La présente Politique peut évoluer. La version applicable est celle en vigueur lors de votre utilisation ; les modifications substantielles vous seront signalées dans l'Application.

KoulChi — Privacy Policy

This Privacy Policy describes how KoulChi collects and processes your personal data in connection with the KoulChi and KoulChi Pro applications. It complies with Algerian Law No. 18-07 on the protection of individuals with regard to the processing of personal data and, as hosting is initially located in the European Union, with the General Data Protection Regulation (GDPR).

1. Data controller

The data controller is "Koulchi" (company being registered), Paris (France) and Oran (Algeria). Contact: cherif.bellahouel@hotmail.com.

2. Data we collect

• Account data: name, email address, phone number (not verified), password (stored only in hashed form).
• Order data: ordered items, amounts (in DA), type (on site / takeaway), pickup slot and code, name and phone provided for the order, special requests.
• Payment data: payment method (cash at pickup; online payment "coming soon"). We do not store any bank details.
• Approximate location: if you allow it, in order to show nearby restaurants.
• Device and notification data: push notification token and platform (iOS/Android), to inform you of your order status.
• Preferences: notification preferences, favourites, cart.
• Reviews and ratings you post.
• Loyalty programme: points and related history, where applicable.
• Restaurant owner data (KoulChi Pro): establishment information (name, phone, address, location, opening hours) and dish photos.
• Proof of consent: type, version and language of the documents accepted, date and time, hashed IP address and technical device identifier (user-agent).
• Technical data: logs and error reports necessary for proper operation and security.

3. Purposes and legal bases

• Providing the Service (account creation, orders, pickup code, status notifications): performance of the contract.
• Geolocation of nearby restaurants and push notifications: your consent (revocable at any time).
• Security, fraud prevention, abuse limitation and improvement of the Service: legitimate interest.
• Retention of orders/payments and proof of consent: legal obligation and legitimate interest.

4. Recipients and processors

Your data is accessible to authorised KoulChi staff and to technical providers acting on our behalf:

• AWS (Amazon Web Services): hosting of the application and storage of images (AWS Lightsail and Lightsail Object Storage), European Union region — Spain (Aragon).
• OpenStreetMap / Nominatim: address geocoding.
• Google (Places): address autocompletion on the restaurant owner side; map display uses the platform mapping service (Apple/Google).
• Sentry: technical error monitoring.
• Expo, Apple (APNs) and Google (FCM): delivery of push notifications.

No SMS is sent at this time; a sending provider located in Algeria may be used later. Your data is not sold to third parties.

5. Hosting and international transfers

Data is currently hosted in the European Union (Spain, Aragon region). A transfer of data outside Algeria may therefore occur, subject to the applicable safeguards. We plan to eventually relocate hosting and storage to infrastructure located in Algeria.

6. Retention periods

Account data is kept for as long as the account exists. When you delete your account, your personal data is anonymised. Orders, payments and records required for accounting, tax and legal obligations are kept, in anonymised form, for the applicable legal period. Proof of consent is kept for as long as necessary to demonstrate compliance.

7. Data security

We implement appropriate technical and organisational measures: encryption of communications (HTTPS/TLS), passwords stored in hashed form (bcrypt), authentication tokens (JWT) with an invalidation mechanism, hashing of IP addresses, access control and limited logging.

8. Your rights

In accordance with Algerian Law 18-07 and the GDPR, you have the rights of access, rectification, erasure (account deletion), objection, restriction, portability, and the right to withdraw your consent at any time. You may delete your account and your personal data at any time, directly from the App (Profile → Delete my account).

9. How to exercise your rights

You may exercise your rights from the "Privacy" screen of the App ("Exercise my rights") or by writing to us at cherif.bellahouel@hotmail.com. You have the right to lodge a complaint with the competent supervisory authority (in Algeria, the National Authority for the Protection of Personal Data; in the European Union, the data protection authority of the country concerned).

10. Push notifications

Push notifications (order status, useful information) require your authorisation and can be disabled at any time in your device settings and/or in the App.

11. Cookies and trackers

The mobile application does not use advertising cookies or trackers for marketing profiling purposes. Only technical tools (error monitoring, operational measurement) are used.

12. Minors

The Service is not intended for persons under 16. If you believe that a minor has provided us with data without authorisation, please contact us so that we can delete it.

13. Changes to the policy

This Policy may change. The applicable version is the one in force at the time of your use; substantial changes will be notified to you in the App.

كولشي — سياسة الخصوصية

تصف سياسة الخصوصية هذه كيفية جمع كولشي لبياناتك الشخصية ومعالجتها في إطار تطبيقي كولشي وكولشي برو. وهي تلتزم بالقانون الجزائري رقم 18-07 المتعلق بحماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطابع الشخصي، وبما أن الاستضافة موجودة مبدئيا في الاتحاد الأوروبي، بالنظام العام لحماية البيانات (RGPD).

1. المسؤول عن المعالجة

المسؤول عن المعالجة هو « كولشي » (مؤسسة قيد التسجيل)، باريس (فرنسا) ووهران (الجزائر). الاتصال: cherif.bellahouel@hotmail.com.

2. البيانات التي نجمعها

• بيانات الحساب: الاسم، البريد الإلكتروني، رقم الهاتف (غير مُتحقق منه)، كلمة المرور (تُحفظ بصيغة مُجزّأة فقط).
• بيانات الطلب: المنتجات المطلوبة، المبالغ (بالدينار)، النوع (في عين المكان / للأخذ)، موعد ورمز الاستلام، الاسم والهاتف المُدخلان للطلب، الطلبات الخاصة.
• بيانات الدفع: طريقة الدفع (نقدا عند الاستلام؛ الدفع عبر الإنترنت « قريبا »). لا نخزّن أي بيانات بنكية.
• الموقع التقريبي: إذا سمحت بذلك، لعرض المطاعم القريبة.
• بيانات الجهاز والإشعارات: رمز إشعار الدفع والمنصة (iOS/Android)، لإعلامك بحالة طلباتك.
• التفضيلات: تفضيلات الإشعارات، المفضلة، السلة.
• التقييمات والعلامات التي تنشرها.
• برنامج الولاء: النقاط والسجل المرتبط بها عند الاقتضاء.
• بيانات أصحاب المطاعم (كولشي برو): معلومات المؤسسة (الاسم، الهاتف، العنوان، الموقع، أوقات العمل) وصور الأطباق.
• إثبات الموافقة: نوع ونسخة ولغة الوثائق المقبولة، التاريخ والوقت، عنوان IP بصيغة مُجزّأة ومُعرّف تقني للجهاز (user-agent).
• بيانات تقنية: سجلات وتقارير الأخطاء اللازمة لحسن سير العمل والأمن.

3. الغايات والأسس القانونية

• تقديم الخدمة (إنشاء الحساب، الطلبات، رمز الاستلام، إشعارات الحالة): تنفيذ العقد.
• تحديد موقع المطاعم القريبة وإشعارات الدفع: موافقتك (قابلة للسحب في أي وقت).
• الأمن ومنع الاحتيال والحد من الإساءة وتحسين الخدمة: المصلحة المشروعة.
• حفظ الطلبات/المدفوعات وإثبات الموافقة: التزام قانوني ومصلحة مشروعة.

4. المستلمون والمتعاقدون من الباطن

بياناتك متاحة لموظفي كولشي المخوّلين ولمزودي خدمات تقنيين يتصرفون لحسابنا:

• AWS (أمازون ويب سيرفيسز): استضافة التطبيق وتخزين الصور (AWS Lightsail و Lightsail Object Storage)، منطقة الاتحاد الأوروبي — إسبانيا (أراغون).
• OpenStreetMap / Nominatim: ترميز جغرافي للعناوين.
• جوجل (Places): الإكمال التلقائي للعنوان لدى صاحب المطعم؛ ويستخدم عرض الخرائط خدمة الخرائط الخاصة بالمنصة (Apple/Google).
• Sentry: مراقبة الأخطاء التقنية.
• Expo و Apple (APNs) و Google (FCM): إيصال إشعارات الدفع.

لا تُرسَل أي رسائل قصيرة حاليا؛ وقد يُستخدم مزود إرسال موجود في الجزائر لاحقا. لا تُباع بياناتك لأطراف ثالثة.

5. الاستضافة والنقل الدولي

تُستضاف البيانات حاليا في الاتحاد الأوروبي (إسبانيا، منطقة أراغون). وبالتالي قد يحدث نقل للبيانات خارج الجزائر، في إطار الضمانات المعمول بها. ونعتزم مستقبلا نقل الاستضافة والتخزين إلى بنية تحتية موجودة في الجزائر.

6. مدد الحفظ

تُحفظ بيانات الحساب طالما بقي الحساب قائما. عند حذف حسابك، تُخفى هوية بياناتك الشخصية. وتُحفظ الطلبات والمدفوعات والوثائق اللازمة للالتزامات المحاسبية والجبائية والقانونية، بصيغة مجهولة، طوال المدة القانونية المطبقة. ويُحفظ إثبات الموافقة طوال المدة اللازمة لإثبات الامتثال.

7. أمن البيانات

نطبّق تدابير تقنية وتنظيمية مناسبة: تشفير الاتصالات (HTTPS/TLS)، حفظ كلمات المرور بصيغة مُجزّأة (bcrypt)، رموز مصادقة (JWT) مع آلية إبطال، تجزئة عناوين IP، التحكم في الوصول وتسجيل محدود.

8. حقوقك

وفقا للقانون الجزائري 18-07 والنظام العام لحماية البيانات، لك حقوق الوصول والتصحيح والمحو (حذف الحساب) والاعتراض والتقييد والنقل، والحق في سحب موافقتك في أي وقت. يمكنك حذف حسابك وبياناتك الشخصية في أي وقت مباشرة من التطبيق (الملف الشخصي ← حذف حسابي).

9. كيفية ممارسة حقوقك

يمكنك ممارسة حقوقك من شاشة « الخصوصية » في التطبيق (« ممارسة حقوقي ») أو بمراسلتنا على cherif.bellahouel@hotmail.com. ولك الحق في تقديم شكوى لدى سلطة الرقابة المختصة (في الجزائر، السلطة الوطنية لحماية المعطيات ذات الطابع الشخصي؛ وفي الاتحاد الأوروبي، سلطة حماية البيانات للبلد المعني).

10. إشعارات الدفع

تتطلب إشعارات الدفع (حالة الطلبات، معلومات مفيدة) إذنك ويمكن تعطيلها في أي وقت من إعدادات جهازك و/أو في التطبيق.

11. ملفات تعريف الارتباط والمتتبعات

لا يستخدم تطبيق الهاتف ملفات تعريف ارتباط إعلانية ولا متتبعات لأغراض التنميط التسويقي. تُستخدم فقط أدوات تقنية (مراقبة الأخطاء، قياس حسن سير العمل).

12. القاصرون

الخدمة غير موجهة للأشخاص دون 16 عاما. إذا رأيت أن قاصرا قد زوّدنا ببيانات دون إذن، فاتصل بنا لحذفها.

13. تعديلات السياسة

قد تتطور هذه السياسة. النسخة المطبقة هي النافذة وقت استخدامك؛ وستُبلَّغ بالتعديلات الجوهرية في التطبيق.
